Native advertising, sponsored content and user-generated content (UGC) have become powerful advertising tools for companies to expand their reach and bottom lines. What legal questions should companies ask when engaging influencers and employing sponsored and user-generated content? Lord&Taylor recently settled charges by the Federal Trade Commission (FTC) for their failure to disclose payment to NYLON and 50 online fashion influencers for their endorsement of a clothing collection. Despite recent clarifications of FTC rules on “deceptively formatted advertisements” and endorsements, the legal landscape regarding the use of sponsored content and UGC is still forming and can be confusing for companies and online influencers.
